ORDER:

1.             Shri Ram Murti, complainant (referred to as complainant in short) has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that on the request of OPs, the complainant availed the services of the Ops by investing an amount of Rs.53,000/- in the shape of FDR with the OPs at Sangrur vide registration number FD0051500128 and customer ID 002178 on 16.11.2015 for the period of 12 months and interest payable was at the rate of 12% per annum on maturity i.e. 15.11.2016 under which the Ops agreed to pay an amount of Rs.58,830/-  Further case of the complainant is that the complainant handed over the original documents for payment to the Ops on 29.09.2016 as its maturity date was 15.11.2016, but the Ops failed to pay the due amount on maturity. Though the complainant approached the Ops at its office at Chandigarh, but the Ops flatly refused to pay the amount. Thus, alleging deficiency in service on the part of OPs, the complainant has prayed that the Ops be directed to release the payment of Rs.58,830/- along with interest @ 18% per annum from 16.11.2016 till realization and further claimed compensation and litigation expenses.

 

2.             Record shows that the Ops did not appear despite service, as such, they were proceeded against exparte.

 

3.             The complainant has tendered documents Ex.C-1 affidavit, Ex.C-2 copy of deposit receipt and Ex.C-3 copy of application regarding maturity and closed evidence.

 

4.             We have very carefully perused the pleadings, evidence produced on the file and heard the arguments of the learned counsel for the complainant. No written arguments have been produced by the complainant.

 

 

5.             From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the complainant, we find that the complainant had invested an amount of Rs.53,000/- with the Ops and in turn the Ops issued the deposit confirmation receipt Ex.C-2, whereby it has been stated that the Ops are liable to pay to the complainant an amount of Rs.58,830/- on maturity i.e. on 15.11.2016, but the case of the complainant is that the Ops failed to pay the amount of Rs.58,830/- on maturity i.e. 15.11.2016 rather closed the office at Sangrur. The Ops have not appeared before this Forum to rebut the case of the complainant rather chose to remain exparte. As such, we feel that since the Ops have failed to pay the due maturity amount of Rs.58,830/- to the complainant, which is a clear cut case of deficiency in service on the part of the OPs.

 

 

6.             So, in view of our above discussion, we allow the complaint of the complainant and direct the OPs to make the payment of Rs.58,830/- to the complainant along with interest @ 9% per annum from 15.11.2016 till realization. We further order the OPs to pay to the complainant a sum of Rs.3500/- on account of compensation and further Rs.1500/- as litigation expenses.

 

7.             This order of ours shall be complied with within 45 days from the receipt of copy of the order.  A copy of the order be supplied to the parties free of charge. File be consigned to records in due course.
