1.             Shri Parveen Kumar, complainant (referred to as complainant in short) has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that on the request of OPs, the complainant availed the services of the Ops by investing an amount of Rs.50,000/- in one time investment plan with OPs at Sangrur vide registration number MS0051400004 on 28.11.2013 for the period of three years i.e. with maturity date as 27.11.2016 under which the Ops agreed to pay an amount of Rs.500/- per month as interest on regular basis.  Further case of the complainant is that the Ops paid interest @ Rs.500/- per month from 27.11.2016 and thereafter the complainant requested the Ops to refund him his amount along with future interest and also deposited the original policy certificate with the Ops on 21.10.2016, but nothing was paid despite repeatedly visit to the Ops by the complainant. Thus, alleging deficiency in service on the part of OPs, the complainant has prayed that the Ops be directed to release the payment of Rs.50,000/- along with interest @ 18% per annum from 27.11.2016 till realization and further claimed compensation and litigation expenses.

 

2.             Record shows that the Ops did not appear despite service, as such, they were proceeded against exparte.

 

3.             The complainant has tendered documents Ex.C-1 affidavit, Ex.C-2 copy of deposit receipt and Ex.C-3 copy of application regarding maturity and closed evidence.

 

4.             We have very carefully perused the pleadings of the complainant, evidence produced on the file and heard the arguments of the learned counsel for the complainant. No written arguments have been filed by the complainant.

 

5.             From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the complainant, we find that the complainant had invested an amount of Rs.50,000/- with the Ops and in turn the Ops issued the deposit confirmation receipt Ex.C-2, whereby it has been stated that the Ops are liable to pay Rs.500/- per month as interest on the said amount. But, the case of the complainant is that after maturity i.e. 27.11.2016, the Ops did not pay interest nor refunded the due amount of Rs.50,000/-, as such the Ops are liable to refund the invested amount of Rs.50,000/- along with interest as agreed upon between the parties. The Ops have not appeared before this Forum to defend the case rather chose to remain exparte. As such, we feel that the Ops are liable to refund the so deposited amount of Rs.50,000/- along with interest @ 12% per annum.

 

6.             So, in view of our above discussion, we allow the complaint of the complainant and direct the OPs to make the payment of Rs.50,000/- to the complainant along with interest @ 9% per annum from 27.11.2016 till realization. We further order the OPs to pay to the complainant a sum of Rs.3000/- on account of compensation for mental torture, pain and agony and further Rs.1000/- as litigation expenses.

 

 

7.             This order of ours shall be complied with within 45 days from the receipt of copy of the order.  A copy of the order be supplied to the parties free of charge. File be consigned to records in due course.
