1.             Shri Jasbir Singh, complainant (referred to as complainant in short) has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that on the request of OPs, the complainant availed the services of the Ops by depositing an amount of Rs.1000/- per month  for 36 months and on maturity the Ops were to pay an amount of Rs.43,486/-, as such the account was opened on 3.1.2014 and deposited the amount of Rs.1000/- per month for 36 months till 2.1.2017. The Ops according issued registration number RD0051400025 customer ID 000101. Further case of the complainant is that the Ops thereafter requested the Ops to pay the due amount and also deposited original documents with the Ops on 3.12.2016, but nothing was paid despite repeatedly visit to the Ops by the complainant. Thus, alleging deficiency in service on the part of OPs, the complainant has prayed that the Ops be directed to release the payment of Rs.43,486/- along with interest @ 18% per annum from 03.01.2017 till realization and further claimed compensation and litigation expenses.

 

2.             Record shows that the Ops did not appear despite service, as such, they were proceeded against exparte.

 

3.             The complainant has tendered documents Ex.C-1 affidavit, Ex.C-2 copy of deposit receipt and Ex.C-3 copy of application regarding maturity and Ex.C-4 copy of pass book and closed evidence.

 

4.             We have very carefully perused the pleadings of the complainant, evidence produced on the file and heard the arguments of the learned counsel for the complainant. No written arguments have been filed by the complainant.

 

5.             From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the complainant, we find that the complainant opened an account with the Ops for depositing an amount of Rs.1000/- per month  for 36 months and on maturity the Ops were to pay an amount of Rs.43,486/-, as such the account was opened on 3.1.2014 and the OPs accordingly issued registration number RD0051400025 customer ID 000101 and from the scrutiny of the documents submitted by the complainant, it has been found that the complainant deposited the amount of Rs.1000/- per month for 34 months only till 2.1.2017. But, the case of the complainant is that after maturity i.e. 2.1.2017, the Ops did not pay the due maturity amount of Rs.43,486/- to the complainant, as such the Ops are liable to refund the due amount of Rs.41,070/- on the proportionate basis along with interest @ 9% per annum from 2.1.2017. The Ops have not appeared before this Forum to defend the case rather chose to remain exparte. As such, we feel that the Ops are liable to refund the due maturity amount of Rs.41,070/- along with interest @ 9% per annum.

 

6.             So, in view of our above discussion, we allow the complaint of the complainant and direct the OPs to make the payment of Rs.41,070/- to the complainant along with interest @ 9% per annum from 2.1.2017 till realization. The Ops are further directed to pay to the complainant an amount of Rs.2000/- on account of compensation for mental torture, pain and agony and Rs.1000/- as litigation expenses.

 

7.             This order of ours shall be complied with within 45 days from the receipt of copy of the order.  A copy of the order be supplied to the parties free of charge. File be consigned to records in due course.
