JUDGEMENT

The case of complainant in CC.599/07 is that the complainant was a chitty subscriber of 1st respondent and had subscribed three chitties. In the chitty No.KTR/8 17th day chitty she had remitted the entire amount and towards JTK KTR/6 25th day kuri she had remitted 46 instalments and towards the 12th day chitty JTK KTR/7 No. chitty she had remitted 37 instalments. In 2007 February when she has gone to remit amounts towards the 2nd and 3rd chitties it was intimated that they are not receiving the chitty amount further and the remitted amount will be returned later. The complainant is entitled to get back Rs.52,800/-, but it was not paid and the complainant was caused to send a lawyer notice. The 1st respondent replied to the notice with false matters and 2nd respondent even if accepted the notice failed to send reply. Now the respondent firm is not working. So the complainant is entitled to get the amount and the non payment of amount is a deficiency in service on the part of respondents. Hence the complaint.
2. The counter of 1st respondent is that this respondent is the Managing Partner of National Bankers and the husband of this respondent who was expired was the Managing Partner of respondent firm. The firm had different branches and had a bank account in the Kuttanellur Service Co-operative bank. After the death of the husband of 1st respondent on 1/3/99, the firm has been reorganized. This respondent was the Managing Partner and their son Samu Francis was the partner. The Manager Stalin was retired from the firm and the clerk Vimala taken the charge of Manager from 2001 August. Sine it became difficult to continue the functioning of Kuttanellur branch the business of that branch was stopped and the entire business was taken over by 2nd respondent branch Manager. The entire assets and liabilities of that branch was taken over by 2nd respondent Vimala and the entire functioning was in her control. The 2nd respondent agreed to change registration in her name and to conduct the firm as the proprietary concern. It was aware of all the subscribers and the complainant also. The Kuttanullur branch has been changed as a proprietary concern after 1/7/04 by 2nd respondent and a bank account has been opened in her name in the Service Co-operative bank, Kuttanellur branch. But the name of firm was not changed. The 2nd respondent misappropriated the money remitted by customers and wanted to this respondent to clear off the liabilities of subscribers. The subscribers submitted a complaint to Ollur Police by stating that the 2nd respondent wanted to the customers to approach the Malipuram branch. It was known that the 2nd respondent was behind this complaint. The entire details with regard to the chitties were in the custody of 2nd respondent and she alone known the defaulted subscribers. There is no branch to National Bankers at Kuttanellur. There is only a proprietary concern at Kuttanellur conducted by 2nd respondent. The 2nd respondent is only responsible for the functioning of firm at Kuttanellur. This respondent did not conduct any kuri transaction. Hence dismiss.
3. The counter of 2nd respondent is to the effect that it is incorrect that this respondent is the Manager of National Bankers, Kuttanellur branch. This respondent was worked as a clerk cum Peon post in that branch. This respondent does not have any financial transactions in the respondent firm. There were salary arrears to this respondent and the firm was remained as closed. It is illegal to implead this respondent as the Manager of National Bankers. This respondent is not at all responsible to pay any amount to complainant. Hence dismiss.
4. There are 24 cases filed against the same respondents to get back chitty amount paid by complainants. In all these cases the averments in the complaint and the averments in the versions filed by respondents are self same. Hence we are not repeating each by each. In all the cases the pass books were produced and marked on the part of complainants and a copy of karar executed between respondents is marked as Exhibit R1 on the part of 1st respondent. The 2nd respondent submitted no evidence. In all the cases both the parties submitted no oral evidence. In this case i.e. CC.599/07 the evidence adduced consists of Exhibit P1 series to P7 and Exhibit R1.
5. The common points for consideration are:
1) Was there any deficiency in service from the respondents?
2) If so reliefs and costs?
6. Exhibit P1 series are the three pass books showing the payment of money towards the chitties conducted by National Bankers. As per Exhibit P1(1) entire amount has been paid by complainant. In Exhibit P2 and P3 chitties some amounts are remaining due. It is the case of 1st respondent that the entire assets and liabilities of Kuttanellur branch of National Bankers were taken over by 2nd respondent by executing Exhibit R1. The copy of karar alleged to be executed between the respondents is Exhibit R1. As per Exhibit R1 from 1/7/04 onwards the 2nd respondent had taken over the assets, liabilities and the entire functioning of 1st respondent firm branch at Kuttanellur. In all the cases the copy of this karar is produced by 1st respondent and has marked as Exhibit R1. In CC.273/07 a similar case in which the original of Exhibit R1 is produced. In all the cases the passbooks shown the payment of money by complainants.
7. As per the contention of 2nd respondent she was never be a Manager of National Bankers, Kuttanellur branch. But she stated that she was only a clerk cum peon. It is her counter that she was not connected with the financial transactions existing in the firm. According to her, her salary was also in arrears. But there is no evidence adduced by her to prove her innocence. Even if a karar is produced in all the cases she has no contention that such a karar was not executed by her. Except this case in all other cases the 1st respondent had taken a contention in the counter itself about the existence of karar executed between Managing Partner, Gracy and Vimala. There is no denial of these averments in the counter of Vimala and no evidence is adduced by her. The counsel for Vimala submitted no evidence on her part in all the cases. There is not at all any averment by denying Exhibit R1 karar. She can very well adduce oral evidence in support of her claim. She did not do so. By executing Exhibit R1 the entire liabilities were cast upon her. But no evidence adduced by her to deny the same. So Exhibit R1 is to be believed and the liability of her is to be established.
8. As per Exhibit R1 the 1st respondent has no liability towards consumers. The 2nd respondent Vimala only is responsible to clear off the liability of all the consumers. The 2nd respondent miserably failed to prove her innocence.

In the result all the complaints are allowed and the 2nd respondent Vimala is directed to return the pass book amounts to the complainants with interest at the rate of 9% per annum from the date of complaint till realization with costs Rs.300/- each in every cases within three months from the date of receipt of copy of this order.
