Parties are present through their respective ld. Advocate and the authorized representatives. This record is placed before the Bench in view of the put up petition filed by the complainant. It is seen by us that on 08.8.2016 the record is fixed for ex parte hearing. The complainant has filed one application stating that as the grievance of the complainant has already been settled amicably out of the Forum, the complainant is not willing to proceed with the complaint. Under this circumstances the complainant prays for an appropriate order by dismissing the complaint for non-prosecution.

It is seen by us that the grievance of the complainant has already been settled by the Ops out of Forum amicably as mentioned in the petition. Hence, the Consumer Complaint be dismissed for non-prosecution.  Hence, it is

that the Consumer Complaint being No. 88/2016 is dismissed for non-prosecution without any cost.
