1. This complaint is filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.

2.  This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. The case was posted to 12/05/2023 for appearance of the opposite parties. Meanwhile the complainant’s counsel filed an IA.No.49/23 to advance the case from 12/05/2023 to this date on the ground that the matter is settled out of court. The complainant also filed a memo to the effect that the matter is settled and the complainant is not willing to further proceed with this complaint in view of the settlement. In order to consider the settlement memo the case was advanced from 12/05/2023 to this day by allowing IA.149/23. The memo filed by the complainant’s counsel is accepted and recorded. In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be dismissed as settled.

           In the result, the complaint is dismissed as settled. There will be no order as to costs.

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
