            1. This complaint is filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration. After hearing the matter, the commission passed an order as follows.

2.  This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint, notice was issued to the opposite parties. After accepting the notice opposite parties 2 & 3 failed to appear before this Commission on the date fixed for the appearance of opposite parties. Hence on 14/04/2022 opposite parties 2 & 3 declared exparte and posted for the steps against first opposite party. The notice issued to first opposite party returned with endorsement “addressee left”. As the complainant was absent, a notice was issued to the complainant to appear before this Commission today to take steps against first opposite party. When the case came up for consideration today, we find that even after accepting the notice from this Commission the complainant failed to appear before this Commission. In the above circumstances, we find that the complainant is not interested to further proceed with this complaint.

              In the result, complaint is dismissed for default. There will be no order as to costs.  

             A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
