Consumer Complaint No.362 of 2013

ORDER

1.         A compromise has been arrived at between the parties with the efforts of Lok Adalat.

2.         Sh.Deepak Verma, Counsel for OP No.1, has made the following statement, recorded separately;-

“The OP No.1 offers to refund the invoice price of mobile set in question (Micromax Superfone Ninja 3 A57), which is Rs.5500/-, alongwith Rs.500/- as costs to the complainant (total Rs.6000/-), in full and final settlement of the dispute, provided the complainant returns all accessories of the mobile set in question Micromax Superfone Ninja 3 A57. The mobile set in question is already in the possession of OP No.3. These amounts will be paid to the complainant within 30 days from today.

I have received all accessories of mobile set in question, alongwith job card and original bill, from complainant in the Forum today.”

3.         Sh.Debashish Ghoshal, Complainant, has accepted the offer and has made the following statement, recorded separately;-

“I accept the offer. I have returned all accessories of mobile set in question, alongwith job card and original bill, to counsel for OP No.1 in the Forum today. The complaint be disposed of accordingly.” 

4.         In view of the above statements, it is ordered that the Opposite Party No.1 (OP No.1) shall refund the invoice price of mobile set in question (Micromax Superfone Ninja 3 A57), amounting to Rs.5500/-, alongwith Rs.500/- as costs to the complainant (total Rs.6000/-), in full and final settlement of the dispute, within 30 days from today i.e. 17.10.2013, failing which the OP No.1 pay the agreed amount (Rs.6000/-) along with interest @18% p.a. from the date of this order till the payment is made.

5.         Hence, the complaint is disposed of accordingly.

6.         Certified copy of this order be communicated to the parties free of cost. After compliance file be consigned.
