Rahul age 24 years son of Rishipal, resident of village Sagga Tehsil Nilokheri, District Karnal.

1.     The Manager, Ess Kay Fincorp Ltd. Sector 3, Industrial Area Karnal.

2.     Bajaj Allianz General Insurance Company Ltd. Sector 12, Karnal through its Manager.

                                                                        …..Opposite parties.

 

Complaint under Section 35 of Consumer Protection Act, 2019.

Present:  Shri Randeep Chauhan, counsel for the complainant.

                Shri Kunal Chopra, counsel for opposite party no.1.

       

               Today mis. application was fixed for order.

         

               At the stage, main file taken up on the request of learned counsels of both the parties as the matter has been settled between the OP no.1 and complainant amicably. Learned counsel for OP no.1 has suffered a separate statement to the effect that OP no.1. i.e. S.K. Finance Limited has received the loan amount as per settlement. He further stated that OP no.1 will issue the NOC within one month and nothing is due against the complainant.

                On the other hand, learned counsel for complainant has suffered a separate statement to the effect that during the pendency of the complaint, complainant has cleared all loan amount, settled with the company and company is ready to issue the NOC within one month. Now new cause of action has arisen. So, he withdraws the present complaint, with permission to file the fresh complaint against the insurance company i.e.2.

                In view of statement of both the parties, the present complaint is dismissed as withdrawn. Misc. application also disposed of accordingly and tagged with main file. However, the complainant would be at liberty to file afresh complaint against the insurance company, if so desired. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
