Final Order & Judgment

This complaint is filed by the complainant under Section 12 of the CP Act, 1986 alleging deficiency in service as well as unfair trade practice against the OP.

Today is fixed for admission hearing of the complaint. None is present on behalf of the complainant and no step taken on his behalf. On scrutiny it is revealed that this complaint was filed on 20.07.2018. The complaint was fixed for admission hearing on 26.07.2018, but on the prayer of the complainant next date was fixed on 01.08.2018 for the same purpose. On 01.08.2018 the complainant prayed for an adjournment which was allowed and date was fixed on 06.08.2018 for admission hearing. On the said date further adjournment was sought for and accordingly it was allowed. On 13.08.2018 the record was fixed for admission hearing, but on the said date due to resolution taken by the Local Bar Association admission could not be made. It is necessary to mention that on 13.08.2018 none was present on behalf of the complainant. Due to Natural Justice further date was given on 16.08.2018, but due to No Quorum admission could not be taken.

On the said date also none was present on behalf of the complainant nor was any step taken. Today also complainant is absent on calls without taking any step.

Since filing of this complaint till date as more than 21 days have already been elapsed, we are not inclined to fix another date for admission hearing, rather we are of the view that as the complainant lost his interest to proceed with this complaint.

Hence the Consumer Complaint No- 292/2018 is dismissed for default without being admitted.

Let plain copy of this order be given to the parties free of cost as per the CPR, 2005.
