            Today is fixed for order in respect of M.A. Case No. 02/2023. Ld. Advocate for the complainant is present and Ld. Advocate for the O.P. No. 1-4 is present. Record is put up for order.

Perused the petition dated 30.12.2021 which registered as M.A case No.02/2023. Complainant stated in the petition that O.Ps have failed and neglected to repair the supply line of water of the taps line attached to the bathroom of the  complainant despite multiple verbal as well as written communications in this regard.

Perused the petition dated 30.12.23 which registered as M.A. case No. 02/2023. He prayed for directions to the opposite parties for repairing of the unsteady flow of water from the taps in the bathroom. We have carefully gone through the petition of complaint filed by the complainant.

We find that the complainant prayed for series of reliefs against the opposite parties . In the petition dated 30.12.2021 complainant alleged that the O.Ps have neglected to fix and repair the supply of water to the tap  and sewerage line in the bathroom of the complainant as well as written communications.

We know that supply of water is very much essential to perform the daily life. Without supply of water it is not possible for a man to reside in a flat. We failed to understand as to why the opposite parties did not take any steps for supply of water in the flat of the complainant as per his verbal and written requests.

  Considering the entire matter we think, that direction should be given to the opposite parties to take necessary action for repairing of the supply line of the water.

In the result the petition succeeds.

Hence,

                        it is ordered,   

            that the petition under section 38 (8) of the C.P. Act, 2019 filed by the complainant which registered as M.A . No. 02/2023 is allowed on contest against the opposite parties but without any order as to cost.

O.P. Nos. 1 and 4 are directed to take necessary steps for repairing of the water supply line so that complainant can get water in his flat including the bathroom.

M.A. Case No. 02/2023 is thus disposed of.

To 16.01.2024 for evidence.     

Let a plain copy of this order be given to the parties free of cost as per CPR, 2005.
