The petition of complaint has been filed by complainant Mahasin Mondal against the o.ps. Micro Finance Institution. The case of the complainants in short is that complainant deposited Rs.2 lakhs in BHP Zonal Office at Nazirpur of Micro Finance Institution, A Division of All India Clench Foundation and according to the said receipt complainant should have collected the permanent money receipt within 60 days from the date of issuance of temporary money receipt dt.27.7.09, but complainant approached o.p. no.1 and also o.p. no.2, but no permanent receipt was issued in favour of the complainant till date. Hence, the case.
O.ps. had entered their appearance in this case by filing w/v denying all the material allegations labeled against them and prayed or dismissal of the case.
Decision with reasons:-
We have gone through the pleadings of the parties and evidence and documents in particular. It is seen from the record vide annex-P1 annexed with the petition of complaint that complainant deposited Rs.2 lakhs only on 27.7.09 at BHP Zonal Office and this position has not been disputed by either of the parties. But the fact agitated by complainant that no permanent receipt was issued in favour of the complainant for the reason best known to o.ps.
In view of the above findings and on perusal of the entire materials on record and documents in particular we hold that o.ps. had sufficient deficiencies on their part being a service provider to its consumer / complainant and complainants is entitled to relief.
Hence, ordered,
That the petition of complaint is allowed on contest with cost against the o.ps. O.ps. are directed to issue pucca money receipt i.e. permanent money receipt of Rs. 2 lacs in default to refund of Rs.2,00,000/- (Rupees two lakhs) only to the complainant together with interest @ 9% p.a. from the date of deposit till the date of realization and o.ps. are further directed to pay compensation of Rs.15,000/- (Rupees fifteen thousand) only for harassment and mental agony and litigation cost of Rs.2000/- (Rupees two thousand) only within 45 days from the date of communication of this order, i.d. an interest @ 9% p.a. shall accrue over the entire sum due to the credit of the complainant till full realization.
Supply certified copy of this order to the parties.
