This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter thecommission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. The 4th opposite party entered appearance and filed written version denying the allegation raised by the complainant. 3rd opposite party filed Vakkalath but not filed any written version. Notice issued to the 2nd opposite party was returned unserved with endorsement ‘addressee left’. As the complainant was continuously absent and there was no representation from the side of the complainant, this Commission issued a notice to the complainant to appear before this Commission on 12/07/2022 to further proceed with this complaint. The said notice was returned unserved with endorsement ‘addressee is no more’. Hence this Commission adjourned the case to this date for impleading the legal heirs of deceased complainant if they are interested. When the case came up for consideration today, there is no representation for complainant and no legal heirs of deceased complainant appeared before this Commission to implead themselves in this complaint to further proceed with this complaint. In the above circumstances we find that the legal heirs of the deceased original complainant are not interested to further proceed with this complaint. In view of the above fact we find that this is fit case to be dismissed for default.
In the result complaint is dismissed for default. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
