ORDER

This Complaint is filed by the Complainant u/s. 12 of the C.P. Act  1986 seeking to recover the amount of Rs.1,59,452/- from the Ops.

 

2.       This Forum has given several opportunities to the Ops, but nobody represents.  In this complaint, Complainant is not a consumer as defined u/s. 2(1)(d) of the C.P. Act.  The transaction between the Complainant and the Ops was buy-back transaction which is commercial in nature.

 

3.       On perusal of the Complaint, it is seen that OP1 used to supply foundation seeds to be grown by the Complainant for payment.  OP2 is the agent of OP1 having grown varieties of seeds.  The Complainant supplied the same to OP1 and OP1 failed to perform his part of the contractual obligation.  Complainant is a service / goods provider to the OP1.  As such, Complainant does not come under the purview of “consumer” as defined u/s. 2(1)(d) of the C.P. Act.  Therefore, it is not a consumer dispute and hence the Complaint is liable to be dismissed and proceed to pass the following order:

ORDER

1.       Complaint is dismissed.  Complainant is at liberty to seek remedy before any appropriate Court of Law / Authority.

 

2.       Office is directed to return extra sets to the parties concerned under the Regulation 20(3) of the Consumer Protection Regulations 2005.

 

3.       Send free copy of the order to the parties.
