1.       This is an application U/s 12 of the C.P.Act, 1986.

2.       The complainant’s case in brief is that, he came to know about an advertisement of Reeta & Sons Jewelry i.e. OP  and learnt that, there is  discount of Rs.5000/- on  the gold rate. On being tempted by such advertisement,  he purchased gold ornaments  weighing about 14.730 gms worth of Rs.50,800/-. The seller did not deduct Rs.5000/- from the total price paid by him as per the advertisement as alleged by the complainant. On being aggrieved, the complainant filed this case.   

3.       On the other hand, the OP did not appear in the case, as such it was set exparte and exparte hearing is taken up on 17/02/2023.

4        Perused the materials on record.   It was advertised by the OP that, there was Rs.5000/- off on the gold rate i.e. gold rate on the date in question was Rs.33,500/- and the OP would sell the gold @ Rs.28,500/-. Admittedly, the complainant had purchased the gold ornaments weighing 14.730 gms and the seller had sold those gold ornaments  to the complainant @ Rs.28,500/- i.e. in accordance  with the advertisement published by the OP. There was no scope of cheating or unfair trade practice  or deficiency in service on the part of the OP. In this backdrop,     the complaint bears no merit.  Hence it is ordered.      

ORDER

The complaint is  dismissed  exparte against the OP  being devoid of merit.

The order is pronounced on this day the   9^th March, 2023  under the seal & signature of the President and Member (W) of this  Commission.
