COMPLAINT UNDER SECTION 35 OF THE CONSUMER PROTECTION ACT, 2019 AS AMENDED UPTO DATE

Present:-      Shri Ankur Chugh, Complainant.

                   Shri Kapil Gupta, Advocate, for the OPs No.1 & 2.

                   Shri Munish Kapila, Advocate, for the OPs No.3 & 4.

 

                   Today, the case is fixed for amicable settlement, before the National Lok Adalat being held at DCDRC, Complex, Panchkula.

                   Sh. Kapil Gupta, Advocate, for the OPs No. 1 and 2, by making a separate statement, states that the OPs No. 1 and 2 are ready to make payment of Rs. 57,205/- to the Complainant, within 45 days from today, in lieu of full and final settlement, in the present complaint. 

                   On the other hand, Sh. Ankur Chugh, Complainant, by making a separate statement, states that he has gone through the statement made by the Ld. Counsel on behalf of the OPs No. 1 and 2, and that he agrees with the same.      

                   Heard. In view of the aforesaid statements made by both the parties, the present Consumer Complaint is hereby disposed of with the direction to OPs No. 1 and 2 to abide by their commitment qua making of payment of Rs. 57,205/- within 45 days from today, to the Complainant. The OPs No. 1 and 2 as well as the Complainant are directed to adhere to their respective statements made by them today, before the Commission. Further, it is clarified that, in case, the OPs No. 1 and 2 fail to comply with their statement qua making of payment of Rs. 57,205/- as settled between them, to the Complainant, within 45 days from today, the settled amount i.e. Rs. 57,205/- shall carry an interest at the rate of 9% (Simple interest) per annum, with effect from the date of this order till its actual realization, and that the complainant shall be at liberty to approach this Commission for initiation of proceedings under Section 71/72 of CP Act, 2019, against the OPs No. 1 and 2.

                   A copy of this order be sent to the parties, free of costs and File be consigned to the record room, after due compliance.
