Ld. Advocate for the Complainant is present. Ld. Advocate for the O.P No. 1-4 is present. Record is put up for order.
Perused the petition dated 10/02/2023 which registered as M.A Case No. 02/2023. Complainants filed this petition U/s 38(8) of the Consumer Protection Act, 2019 praying for order. They alleged that they have filed the present case against the O.P No. 1-4 for redressal in respect of their authorized grievance.
Respondent have failed and neglected to fix and repair the supply of water to the taps attached to the bathroom of the petitioner despite verbally as well as written connection in this regard.
Water being an absolute necessity, irregularity in its supply has greatly affected the petitioners. They prayed for necessary order. During hearing, Ld. Advocate for the Complainant argued that they are actually suffering for irregular supply of water. Ld. Advocate for the O.P No. 1-4 argued that allegations are totally false.
We have carefully gone through the record and find that Complainants in their petition of complaint raised series of allegations against the Opposite Parties.
No doubt water is an absolute necessity. Irregularity of its supply may affect the daily life of the Complainants.
Considering the entire matter we think that a direction should be given to the O.P No. 1-4 as an interim relief U/s 38(8) of Consumer Protection Act, 2019.
In the result, petition succeeds.
Hence,
It is Ordered:-
That the petition dated 10/02/2023 filed by the Complainants which registered as M.A. Case No. 02/2023 [U/s 38(8) of Consumer Protection Act, 2019] be and the same is allowed on contest against the Opposite Parties but without any order as to cost.
Opposite Party No. 1-4 jointly or severally are directed to take necessary steps and to repair the pipe line if required so that water in the supply line connected in the residential house of Complainants and Complainants can get the water from the aforesaid pipe line.
