T.NAGARAJA, Member. Smt. K.G.SHANTALA, Member. --- Consumer Complaint No.38/2008 R.Nagabushana, K.Ramachandraiah, Aged about 40 years, R/at Tayalur Village, Mulbagal Taluk, Kolar District. Complainant (By Advocate Sri. B.N.Srinivasa & Others) V/S 1. The Managing Director, Kolar District Co-operative Central Bank Ltd., Head Office, Kolar. 2. The Manager, Kolar District Co-operative Central Bank Ltd., Mulbagal Branch, Mulbagal. Opposite Parties (OP-1 Ex-parte) (OP-2 by Branch Manager) ORDERS This is a complaint under section 12 of the Consumer Protection Act, 1986 praying for a direction against the opposite parties to pay a sum of Rs.2,250/- to the complainant with compensation and interest at 24% per annum from the date of deposit till the date of realization with costs etc., CC No.38/2008 2. The opposite party No.2 appear and filed memo on 19.08.208 reporting that the claim in the complaint has been fully settled out of Fourm and filed copy of the affidavit sworn by complainant to that effect. Thereafter the complainant or his counsel remained absent. 3. We perused the records. The admitted signatures of complainant available in the record tally with the signature found on the affidavit sworn by complainant on 07.08.2008 before Notary. In one of the previous hearing dates OP-2 was advised to settle the claim amicably impossible. In the above circumstances we hold that the claim is fully settled out of Forum. Hence we pass the following: O R D E R The complaint is dismissed. Parties to bear their own costs.
