The complainant’s case in a nut shell is that the complainant purchased a Micromax canvas 2 plus mobile phone through online vide order no.YBH435880 on 11.09.2013 at the cost of Rs.11,129/-.  EMI charge was Rs.200/- extra.  The goods should be delivered within 10-15 days i.e., on 28^th September, 2013, but he did not receive the goods till 3^rd October, 2013.  On 4^th October, 2013 he came to know by e-mail that order had been cancelled.  On 05.10.2013, complainant was informed that the amount of Rs.11,120/- had been refunded in his account.  On checking the account, complainant came to know that OP Company refunded Rs.10,920/-, but the cancellation charge was Rs.200/-.  Accordingly, Rs.11,000/- about had to be given in his account.  The complainant informed the OP, but no response.  The complainant waited for a long time, but did not get any positive response regarding deduction of Rs.200/-.  Hence, this case. 

This case has been heard ex-parte. 

The complainant has filed document marked as Annexure A, B, C, D & E.

The complainant paid Rs.11,120/-, but the OP did not pay the booked article.  But OP has sent Rs.10,920/- in the account of the complainant.  Rs.200/- has been deducted as PG Charges.

From the statement of the complainant, it appears that the OP informed the complainant regarding no stock of article in question.  So, it appears that there is no deficiency in service on the part of the OP.  as the complainant is not entitled to get any relief.

Hence, it is

that the case is dismissed ex-parte.

Let a copy of this order be supplied to the complainant free of cost.
