Complaint coming up for hearing on admission. Complainant alleging deficiency in service on the part of opposite parties in not providing appropriate after sale service. Heard complainant regarding the territorial jurisdiction. On going through the complaint, it is seen that the office of opposite party No.1 is at Pune and office of opposite party No.2 is at Trichur. Opposite party No.3 is impleaded for the reason that it is the service centre of opposite party No.1 at Palakkad District. It is seen that no cause of action has arose within the territorial limits of this Forum. Hon’ble Supreme Court in M/s Sonic Surgical V/s National Insurance Company Ltd. has held that branch office contemplated under the Act means the branch office where cause of action has arisen.
In the light of the above decision, without going to the merits of the case, we dismiss the complaint.
In the result, complaint dismissed with direction to approach appropriate Forum for relief.
