By G. Yadunadhan, President:

The case of the complainant is that he booked a TVS Victor GX motorcycle on 20.3.2007 from Wings Motors, Mukkam, by giving discount coupons of RMP Infotech Pvt. Ltd. worth Rs.4500/- .  On 28.4.2007, complainant paid Rs.6500/- to the opposite party and the opposite party arranged a loan from HDFC Bank for the balance amount of Rs.39000/-.  After receiving the entire amount, opposite party delivered the vehicle to the complainant.  After getting the delivery of the vehicle, complainant started to remit the monthly instalments and finally it was closed.  While closing the loan, complainant came to know that the discount coupon issued by RMP Infotech Pvt. Ltd. for Rs.4500/- has not been credited to him.  Hence the complainant is seeking relief against the opposite party to realize an amount of Rs.25,000/- for the deficiency of service on the part of opposite party.

After serving notice, opposite party filed version denying all the allegations made by the complainant.  When the case was posted specifically for the evidence on 24.12.2008, opposite party called absent and set exparte.

Complainant filed affidavit and he was examined as PW1.  Ext. A1 to A3 were marked on the side of the complainant.

From the evidence of PW1 and from the Exts. A1 to A3, complainant’s case is proved.

In the result petition is allowed and the opposite party is directed to pay an amount of Rs.4500/- and a cost of Rs.250/- to the complainant.

Pronounced in open Court this the 27th day of February 2009.
