F I N A L O R D E R
1. The instant case was filed by complainant U/S 12 of the C.P. Act, 1986,
as amended against the O.P. alleging deficiency in service U/S 2( 1 )( g ), 2( 1 )( o ) of the C.P. Act, 1986 wherein the complainant has prayed for direction upon the o.p. to deliver the products namely Padmini Mixer Grinder – Marval and Nikon Coolpix L 24 Digital Camera or in the alternative to refund the amount of Rs. 5,545/- paid through Standard Chartered Credit Card with card no. 7010, the transaction ID being 10086668 and also through ICICI Bank credit card ( Rs. 4,285/- ) with card no. 6188, the transaction ID being no. 10088430, together with the compensation of Rs. 20,000/- and litigation costs.
2. The o.p. did not ultimately appear before this Forum in spite of proper
service of notice. So the case was heard ex parte against the o.p.
3. Upon pleadings two points arose for determination :
i) Is there any deficiency in service on the part of the O.P. ?
ii) Whether the complainant is entitled to get any relief as prayed for ?
DECISION WITH REASONS :
4. Both the points are taken up together for consideration. The complainant by filing affidavit stated in no uncertain terms that he paid Rs. 1,260/- for Padmini Mixer Grinder through his Standard Chartered Credit Card on 15-02-2012. On 21st Feb’12 he paid Rs. 4,285/- through his ICICI Bank Credit Card. For non delivery of the same he wrote a letter to the Managing Director, Timtara Com, Infosecure Consulting Pvt. Ltd. B-26, Second floor, Sector 8, Noida, Uttar Pradesh – 201301, address on 23-05-2012. The unchallenged documents unerringly indicate that the o.p. in spite of delivering the items misappropriated the amount. The complainant was attracted at the irrational propaganda for delivery of the goods in dispute. This is a fit case where the complainant shall be granted relief as prayed for. Both the points are accordingly disposed of.
Hence,
O R D E R E D
That the C. C. Case No. 69 of 2012 ( HDF 69 of 2012 ) be and the same is allowed ex parte with costs against the o.p.
The O.P., The Managing Director, Timtara Com, Infosecure Consulting Pvt. Ltd., B-26, Second Floor, Sector 8, Noida, Uttar Pradesh – 201301, be directed to deliver the articles namely Padmini Mixer Grinder – Marval and Nikon Coolpix L 24 Digital Camera to the complainant within 30 days from the date of this order or alternatively to refund the amount to the tune of Rs. 5,545/- within the aforementioned date.
The complainant is entitled to a compensation of Rs. 10,000/- for mental agony and prolonged harassment and a litigation costs of Rs. 1,000/-.
The o.p. be directed to pay the same within 30 days from the date of this order failing the amount shall carry interest at @ Rs. 12% per annum.
The complainant is at liberty to put the decree into execution after expiry of the appeal period.
Supply the copies of the order to the parties, as per rule.
