Case is fixed to-day for further orders. Complainant is absent. After perusal of the complaint petition along with reply of the OP it came to lime light that the address chart of the OP given in the complaint is situated at Delhi. From the reply sent by the OP dtd. 25.06.2015 it has challenged the maintainability of the complaint for want of territorial jurisdiction, in view of the decesion of Hon’ble Supreme Court of India in Civil Appeal No.1560/2004 title Sonic Surgical Versus National Insurance Co. Ltd. We are satisfied that, this Forum is not haviang any territorial jurisdiction to adjudicate the case in hand as no cause sof action has been arising within the territorial jurisdiction of this Forum.

Accordingly the case is dismissed.
