This complaint is filed by the complainant seeking compensation of Rs.10,00,000/- with cost of the Complaint u/s 12 of the Consumer Protection Act.1986.
1.THE COMPLAINT IN BRIEF:
The Opposite Parties are in the business of promoting and developing townships, Villas, Residential Houses and Apartments etc. The Complainant are the husband and wife. The 1st Opposite Party developed a villas house in the project “Medo Villa” project. The 2nd Complainant booked a villa in the said project type-B, Villa No.29 with super built area 1215 sq ft. together with undivided share land measuring 1000 sq.ft by paying advance sum of Rs.1,00,000/- by way cheque dated 08.12.2011. After that the 2nd Opposite Party developed a project called “Crescent Parc Dewy –Terraces- 4” at Tiruporur Village, Kanchipuram District. The Complainants also booked in the second project in J-block, Flat bearing No.J4-303 in the name of the 1st Complainant and another flat in J-block, Flat bearing No.J4-304 in the name of the 2nd Complainant. The Complainants requested the Opposite Parties to adjust the advance amount of Rs.1,00,000/- paid in the first project to the 2nd project and apart from that the also paid a sum of Rs.2,10,000/- through cheque dated 15.03.2012. The 1st Complainant also paid a sum of Rs.28,59,902/-. However, the Opposite Parties have not provided site plan, copies of title documents and also agreement for sale and construction of flat. The Complainants repeatedly requested the Opposite Parties to provide necessary documents. Even after payment of the cost of the flat, the Opposite Parties have not adjusted 1,00,000 advance amount and not provided copies of documents and agreement for sale of construction of flat in respect of the 2nd project and site plan establishes that the Opposite Parties committed unfair trade practice and deficiency in service. Hence the Complainants filed this Complaint seeking the above said reliefs and compensation of Rs.10,00,000/- with cost of the Complaint.
2. WRITTEN VERSION OF THE OPPOSITE PARTIES IN BRIEF:
The Opposite Parties admits that the Complainants paid an advance amount of Rs.1,00,000/- and booked a flat in the first project and thereafter they have booked two flats in their second project and requested them to adjust the advance amount of Rs.1,00,000/- in the second project. The 1st Opposite Party accepted their request and requested to forward the cancellation kit for processing the same. However, they have not furnished the cancellation kit and hence the amount could not be adjusted in the second project. The Opposite Parties have properly constructed the flats in time and ready for handing over possession and at the time they have demanded the Complainant to pay the balance payment to fulfill the requirement for 90% of the total sale consideration. It is only the Complainant who has delayed the payment towards the cost of the flat. Due to non payment, the 1st Opposite Party was constrained to terminate the allotment as per clause 4 of the application for advance booking of apartment. Hence these Opposite Parties have not committed any deficiency in service and prays to dismiss the Complaint with cost.
3. POINTS FOR CONSIDERATION:
1. Whether there is deficiency in service on the part of the opposite parties?
2. Whether the complainant is entitled to any relief? If so to what extent?
4. POINT NO :1
The Complainants alleged deficiencies and seeking the following reliefs that to withdraw the cancellation of the allotments of flat in the second project flat No.J4-304, to adjust the sum of Rs.1,00,000/- paid as advance in the first project, to provide the copies of the title documents of the second project, to execute agreement for sale and construction of the flat, to provide site plan of the second project and to adjust the sum of Rs.92,421/- paid by them by way of excess amount.

The counsel for the Complainants submitted that he will argue for compensation only in respect of delay in handing over the flat to the Complainants and since the other defects mentioned in the Complaint have been rectified by the Opposite Parties during the pendency of this proceeding and hence he is not pressing the other reliefs sought for.
6. Therefore, in this case the point for consideration is whether the Opposite Parties have handed over the flats with a delay of agreed date to be handed over in the construction agreement.
7. The Complainants filed Ex.A60 Draft Agreement for Sale and Constructions. Ex.B16 is the Registered Construction Agreement dated 04.04.2016 between the 2nd Opposite Party and the Complainants. In the said constructions agreement in clause 5.4 agreed to complete the development of the apartment on or before 16.05.2016 as far as possible with grace period of three months. The Complainants took possession under Ex.B19 Possession Certificate dated 20.04.2016. Therefore, the Opposite Parties have delivered the possession under Ex.B19 well in advance before the delivery date fixed in the construction agreement. Therefore, as argued by the Complainants counsel there was no delay in handing over the flat to the Complainants and therefore, it is held that the Opposite Parties 1 & 2 have not committed any deficiency in service.
8. POINT NO:2
Since the Opposite Parties have not committed any Deficiency in Service, the Complainant is not entitled for any relief and the Complaint is liable to be dismissed.
In the result the Complaint is dismissed. No costs.
