Final Order

          The OP 1, 2 and 3 are present through their Ld. Advocates. Heard their submissions. On the contrary no one is appeared on behalf of the complainant.

          It is now 3.55pm. It is submitted by the Ld. Advocate for the OPs that the instant case should be dismissed for default as the complainant did not turn up to comply the order of this Forum. On perusal of the record it appears that the cost was imposed upon the complainant on 27.02.2018 amounting to Rs. 500/- which should be paid on the SCWF on the next date positively i.d. appropriate order will be passed.

It further prays from record that from 12.06.2018 the OPs are present but the complainant was absent without taking any step. In this situation the complainant was directed to show cause as to why the compliant shall not be dismissed due to non-compliance of the Forum’s Order.

          We are in view that the complainant is absent today without taking any step. Conduct of the complainant since worse that the complainant is not willing to proceed the case, as such in our view the compliant deserves an order of dismissal.

          Hence it is ordered that CC 247/2017 is hereby dismissed for default.

           Let plain copy of this order be given to the parties free of cost as per the CPR, 2005.
