Compromise memo filed by the parties on both sides. M/s. United India Insurance Company Ltd. has offered a sum of Rs.1,75,000/- (Rupees One Lakh Seventy Five Thousand only) as compensation for the death of minor child Badsha Rahman, son of the complainants No.1 and 2 and brother of the Complainants No.3 and 4 and the complainants have agreed to accept the offer made by opposite party No.2 in full and final settlement of the claim. The complainants have also agreed that they will not make any other claim before any other authority against any liability of the opposite party No.1 under the policy No.100805/48/10/88/00001462.
The opposite party No.2 agreed to pay the amount Rs.1,75,000/- (Rupees One Lac Seventy Five Thousand only) to the complainant within one month from the date of the compromise award. In default, the complainants are entitled to realise the compromise award amount with interest @ 9% per annum from the date of default. The complainant certifies that the compromise has been made for the benefit of Minors.
Memo submitted with the prayer to pass a compromise award in terms of the memo in favour of the complainants proportionating the share as shown in accordance with the Mohomedan Law.
In the result, the complaint is allowed, directing 2nd opposite party to pay an amount of Rs.1,75,000/- (Rupees One Lac Seventy Five Thousand only) to complainants in the following proportion
1st Complainant : 6/24 th shares
2nd Complainant : 4/24 th shares
3rd complainant (minor) : 7/24th shares
4th complainant(minor) : 7/24th shares
within one month from the date of this order failing which complainants shall be entitled for interest at the rate of 9% per annum from the date of this order failing which complainants shall be entitled for interest at the rate of 9% per annum from the date of order til realisation. Complainant shall also be entitled to execute the order asper the provisions of Consumer Protection Act after the expiry of 30 days.
