Learned Counsel Mr. Bimal Kanti Nath is present for the complainant. 

We heard Mr. Nath on the matter of admission of the complaint but we find there are in-consistent statement/ averment at Para-4 as well as at Para-9 in the complaint petition. The inconsistency is about the facts of the case. When we pointed out the matter Mr. Nath fairly submits that at this stage he will withdraw the complaint. 

So, we allow the verbal prayer of Mr. Nath with liberty to file fresh complaint, if they desire.
