1.       This is an application U/s 12 of the C.P.Act, 1986.

2.       The complainant’s case in brief is that, he had engaged the OP to transport some of his house-hold articles from Akurdi, Pune to Bhubaneswar. The house-hold articles include TV, Mattresses, Gas stove,  small cylinder and four boxes full of other materials. The cost of these house-hold articles was around Rs.29,500/- and he has paid Rs.8500/- to the OP to transport the said articles from Akurdi, (Pune) to Bhubaneswar.  But the OP  did not deliver these articles to the complainant at his destination. Hence this complaint.   

3.       On the other hand, the OP did not appear in the case, as such it was set exparte.

4        On perusal of complaint petition as well as the materials produced by the complainant, it appears that the complainant had engaged the OP to transport some of his house-hold articles from Akurdi  (Pune)  to Bhubaneswar. But the OP never delivered those house-hold articles to the complainant at his destination. Therefore, it certainly amounts to deficiency in service and as such the complainant is entitled to get compensation. Hence it is ordered.      

ORDER

The complaint is  allowed exparte against the OP. The OP is  hereby directed to  pay the amount of Rs.29,500/-  (Rupees twenty-nine thousand five hundred) only to the complainant for the deficiency in service. The OP is further directed to pay a sum of Rs.5,000/-   (Rupees five thousand) only towards mental agony suffered by the complainant and a further sum of Rs.2000/-  (Rupees two thousand) only towards litigation expenses.  The order be complied with by the OP   within thirty days from the date of communication of this order,   failing which the complainant will be  at liberty to execute the order  against the OP   in accordance with law.

The order is pronounced on this day the 5^th July,  2022  under the seal & signature of the President and Members  of the Commission.
