Ojha, Sr. Member: - The brief facts of the complainant’s case is that, the complainant was assured by the O.P to provide better job and for that the O.P has taken Rs.1685/- only and further demanded Rs.4,999/- for tax for taking training from manager. The complainant didn’t like the approach of O.P and requested for cancellation of his registration and refund of the same. The O.P demanded bank data of complainant and to be online for deregistration and instructed to enter No. 9776 but the complainant shocked to see that Rs. 9776/- only debited from his said bank account which the O.P fraudulently extract money. After being approached by the complainant the O.P assured to refund the same but till date no action, hence this case. Notice issued through e-mail after the first notice returned back and after receiving the second notice the O.P failed to appear or filing of his written version and as such stand ex-parte ultimately. Heard from the complainant gone through the case record. The complainant trapped in the net of O.P as the O.P by mis-convincing taken Rs.1685/- and Rs. 9776/- only from the complainant by assuring to provide better job in the companies but failed to do so. False assurance for providing services to any citizen / consumer by taking money for the same is nothing but clear-cut example of deficiency in service and unfair trade practice, which exactly happened in the present case. On the above facts and circumstances, this Hon’ble Forum allows the complaint petition by directing the O.P to pay to the complainant Rs.11,461/- (Rupees eleven thousand four hundred sixty one) only which taken from the complainant along with pay a sum of Rs.10,000/- ( Rupees ten thousand) only towards harassment, mental agony including cost of this case, within 30 (thirty) days from the date of receipt of this order, failing which the O.P. shall be liable for interest @ 10 % per annum on the above mentioned awarded amounts till realization. Accordingly the case is disposed of. Order pronounced in the open court today the 29th day of July’ 2015 and copy of this order shall be supplied to the parties as per rule. I Agree.
