This complaint is filed by the complainant u/s 12 of the Consumer Protection Act.1986.

Counsel for Opposite Party  present.  No representation for Complainant till 2.55 p.m. The Complainant filed memo on 09.06.2016  in the office stating that the Opposite Party credited a sum of Rs.96,577/- on 26.04.2016 towards full and final settlement to the Complainant and hence she is withdrawing the Complaint and orders may be passed.  After filing of such memo this Forum adjourned the case for appearance of the Complainant or her counsel   to ascertain  the genuineness of the contents of the memo for the hearings 15.07.2016, 02.08.2016,16.08.2016 ,29.08.2016 and today (01.09.2016). However non of them appeared in all the above hearings. However the Opposite Party counsel represented that we have already settled the amount to the Complainant. The Opposite Party counsel has not subscribed signature in the memo. Therefore we hold that the  non appearance of the Complainant only establishes  that she has no interest in prosecuting the Complaint and hence we have decided to dismiss the Complaint for non prosecution.

          In the result the Complaint is dismissed.
