Jawahar Lal Sood Versus The Manager, Suwidha Centre & Ors
Present :- None for the Complainant.
We have gone through the complaint and facts of the complaint, the Complainant alleged that he required some old documents from the copying agency' one was copy of Will dated 29.06.1968 and the other was copy of the Power of Attorney dated 05.04.2000 and he applied for the same in the office of Suwidha Centre, Jalandhar on 26.08.2016 and deposited the requisite fee of Rs.500/- as Govt Fee and Rs.30/- as CSC/Suwidha Fee for the copy of the Will and 200/- as Govt. Fee and Rs.30/- as Suwidha Fee for the copy of Power of Attorney and two different receipts were issued in the name of the complainant and a tentative date of delivery was given as 06.09.2016.
Despite repeated efforts of the complainant, such copies were not supplied to the complainant and as such Opposite Parties committed negligent and deficiency in service which has caused undue harassment, inconvenience, tension and mental agony and as such, the present complaint filed by the complainant on account of deficiency and negligence in service on the part of OPs as well as undue harassment, inconvenience to the complainant and to pay a sum of Rs.15000/- and cost of litigation.
We have considered the submission made in the complaint for admission of the complaint and find that the instant complaint is not maintainable before District Consumer Forum because the Complainant has two remedies i.e. he can go under RTI Act and Right to Service Act and accordingly we do not find any force in this complaint and therefore, same is dismissed. Copy of this order be supplied to the Complainant, free of costs under the rules. File be consigned to the record room.
