The complaint is filed under section 12 of the Consumer Protection Act against the opposite parties to get cost and compensation for the deficiency of service.
2. Brief of the complaint:- The complainant is a consumer of Idea Cellular Limited for the last 8 years vide mobile No.9947678550. He obtained a postpaid connection in which the rent is limited to a sum of Rs.199/- per month. But on 26.10.2015 he received a bill during the period 21.09.2015 to 20.10.2015 for a sum of Rs.249/-. Thereafter on 03.11.2015 complainant submitted a request to correct the bill amount before the customer care centre. Then they informed the complainant that they were forwarded the request to the main office and they will rectify the mistake within short time. But till this date of complaint no response was received by the complainant. Hence filed this complaint.
3. Notices served to opposite parties, but they were not appeared and not filed version. Hence they were set ex-parte and proceeded with the case.
4. On considering the complaint and documents the Forum raised the following points for consideration:-
1. Whether there is any deficiency of service on the part of opposite parties?
2. Relief and cost.
5. Point No.1:- Complainant filed affidavit and examined as PW1. Ext.A1 to A3 documents were marked. Ext.A1 is the Copy of the Bill dated 21.09.2015. Ext.A2 is the Bill dated 21.10.2015. Ext.A3 is the Customer Request Form dated 03.11.2015. Complainant alleged that on 21.10.2015 he received Ext.A2 bill from opposite party No.1. The monthly charges shown in Ext.A2 is not correct. He is a consumer of opposite party No.1 for the last 8 years and this connection is a postpaid one and the rent fixed per month is Rs.199/- only. But while issuing the Ext.A2 bill opposite party No.1 mistakenly noted Rs.249/- instead of Rs.199/-. After his written request (Ext.A3 dated 03.11.2015) opposite parties were not ready to rectify the incorrect bill. Hence he alleged deficiency of service against opposite parties. On verification of previous bill Ext.A1 we found that rent fixed per month to this connection is Rs.199/-. But in Ext.A2 Rs.249/- is shown as monthly charge. Hence we noticed a mistake in Ext.A2 bill. Opposite parties were not present to clarify the reason for charging excess amount. Hence we are of the opinion that there is deficiency of service from the part of opposite parties. Point No.1 is found accordingly.
6. Point No.2:- Since the Point No.1 is found in favour of complainant, he is entitled to get relief as prayed in the complaint.
In the result, the complaint is partly allowed and the opposite parties are directed to cancel the bill dated 21.10.2015 (Ext.A2) and issue corrected bill to the complainant for the period 21.09.2015 to 20.10.2015. Opposite parties are also directed to pay Rs.1,500/- (Rupees One Thousand Five Hundred) as cost and compensation to the complainant. This Order must be complied by the opposite parties within 30 days from the date of receipt of this Order.
