Per Shri. Mr.D.N.Admane , Hon`ble Presiding Judicial Member.

Heard Adv.P.P.Kulkarni for applicant. This application is filed for withdrawal amount of Rs 15,000/- out of Rs 25,000/- deposited by non applicant in Appeal No. 681/2010. As per order dated 04/01/2012 the order of the Dist. Forum is modified and respondent No. 2 i.e. original opponent No. 1 and 2 are directed to pay jointly and severally Rs 15000/- within a period of 30 days failing which amounts will carry interest @ 6 % p.a. till the realization of the amount. It is submitted by the applicant that the appellant opponent No. 1 had deposited amount Rs 25000/- at the time of filing appeal and that as per order in appeal amount Rs 15000/- is to be paid to applicant/complainant by the appellant. There is no material to show that any appeal is preferred by Insurance Company land it is pending. Application allowed. Registry to pay amount of Rs 15000/- to the applicant/respondent No. 1 Vikas Baburao Shelake out of Rs 25000/- deposited at the time of granting stay as statutory amount. Registry to pay rest of the amount to the original appellant/non applicant No.1. M.A. is disposed off accordingly.
