        Complaint u/s 35 of the Consumer Protection Act, 2019

ORDER:                    

 

                Complaint presented today. It be checked and registered.

 

                        The complainant has filed the present complaint u/s 35 of the Consumer Protection Act, 2019 against the opposite parties (hereinafter referred to as ‘OP’) on the averments that on 05.05.2022   she booked a gas cylinder and at that time cost of the cylinder was Rs.956/- , but at the time of delivery of the said cylinder the OPs have charged Rs.1006/- instead of Rs.950/-. In this way there is deficiency in service on the part of the OPs.  Hence this complaint.

2.             Arguments heard on the point of admissibility.

3.             Complainant has alleged that at the time of booking the cost of the cylinder was Rs.956/-, but  at the time of delivery, OPs have charged Rs.1006/-. Complainant has not placed on record any proof to prove that at the time of booking dated 05.05.2022 the cost of cylinder was Rs.956/-. OPs have charged Rs.1006/- and in this regard OPs have issued invoice. There is nothing on the file to prove the version of the complainant. Hence complaint is devoid of any merits and same deserves to be dismissed and same is hereby dismissed at the stage of admission. Party concerned be communicated of the order accordingly and file be consigned to the record room.
