ORDER

ADV. RAVI SUSHA, MEMBER. The complaint stands filed for getting Rs.20,000/- from the opp.party and for other relief. The averments in the complaint can be briefly summarized as follows: The complainant’s marriage was solemnized on 22.1.2006 at Navaratna Auditorium Vavuakkavu, Karunagappally. The complainant approached the opp.party’s office and booked 3 buses for bridegroom party trip starting from complainant’s house to the auditorium. Opp.party agreed the terms and conditions put forward by the complainant and the complainant gave Rs.1000/- as advance amount and fixed the balance amount Rs.7,400/-. Both of them entered into an agreement. As per the agreement the 3 buses had to reach on the spot on 22.1.2006 at 10 a.m.. But the buses had not come to the spot. Complainant called other vehicle instead of opp.party’s vehicle and fore the rent of the above vehicles Rs.20,000/- has been expensed. Act of the opp.party caused loss to the complainant and seeks relief. Points that would arise for consideration: 1. Whether there is deficiency in service on the part of the opp.party. 2. Reliefs and costs. PW.1 is examined and Ext.P1 to P3 are marked. Points 1 and 2: The complainant was examined in chief as PW.1 and marked Ext.P1 to P3. The opp.party filed version but did not adduce evidence and was absent. Hence stands declared exparte. The complainant could prove his case through the complaint, affidavit and deposition in chief and the Exts. Marked. The complaint was heard. Therefore the complainant is entitled to get relief. In the result the complaint is allowed. The opp.party is directed to pay Rs.10,000/- with 9% interest from the date of 22.1.2006 till the date of realization to the complainant. The opp.party is further directed to pay Rs.5,000/- as compensation and Rs.1000/- as cost to the proceedings. The order is to be complied with within one month from the date of receipt of the order.
