ORDER

           This is a complaint filed under section 12 of the Consumer Protection Act, 1986.

2. The complainant is a portal agent of the opposite party insurance company.  He has approached this Commission seeking reinstatement of cash- cheque facility by the opposite party and also claiming compensation of Rs.50,000/- from the opposite party.
3. The opposite party has entered appearance and filed written version, inter alia, contending that the complaint is not maintainable since the complainant is not a consumer as defined under Section 2(1)(d) of the Consumer Protection Act, 1986.  The opposite party has also filed a petition as IA No.210/2019 to dismiss the complaint for want of jurisdiction.
4. Heard both sides as to the maintainability of the complaint.  Admittedly, the complainant is the portal agent of the opposite party.  According to the definition of consumer in Section 2(1)(d) of the Consumer Protection Act, 1986, a person who hires or avails of any services for consideration is a consumer.  The complainant herein is the portal agent and he has not hired/availed any service of the opposite party for consideration.  There is no consumer dispute warranting the interference of this Commission.   The complaint is not maintainable before this Commission.

In the result, the complaint is dismissed as not maintainable.No order as to costs.
