The complainant had purchased a mobile phone from opposite party on 28.12.2020. The phone was became damaged on January. The complainant had informed the opposite party to the damage of phone and they told her to contact the service centre. The service centre demanded Rs 2895/- to repair the mobile phone within the warranty period. Also they had charged Rs.119/- as inspection charges. The complainant informed several times to repair the mobile phone from the opposite party and finally they demanded amount to repair within the warranty period. The complainant had to buy a second hand mobile phone for an amount of Rs.6000/- (Rupees six thousand only) to her online class and examination. But that mobile phone is not suitable to online class. The acts of opposite parties amounts to deficiency in service. Hence the complaint.

After accepting the notice the opposite party not present before the Commission. So the opposite party set exparte.

Complainant filed chief affidavit and documents. Exts.A1 to A6 marked.

Issues to be considered are

  1. Whether there is any deficiency in service and unfair trade practice on the side of the opposite party?
  2. If so what is the relief and cost?

Issues I & II

             As per Ext.A1 the complainant had purchased the mobile phone from the opposite party for an amount of Rs.10, 498/-. Ext.A2 shows that Protection start date from 28.12.2020 to 28.12.2022. As per Ext.A3 the complainant had paid Rs.119/- as inspection charge dated 15.02.2021. As per Ext.A6 the complainant is studying in B.Sc from 2020 to 2023 at Government College for Women, Thiruvananthapuram. The opposite party has not produced evidence to disprove the case of complainant. The complainant stated that she could not attend the online class and exams due to the damage of phone.  

            In the above discussions we find that the act of opposite parties amounts to deficiency in service.

                    In the result complaint allowed. We direct the opposite party to pay Rs.15,000/- (Rupees fifteen thousand only) as the price of the mobile phone and compensation and pay Rs.2500/- as cost of the proceedings within one month from the date of receipt of order, failing which the amount except cost carries interest @ 9% per annum from the date of order till realization. After complying the order the complainant shall hand over the mobile phone to opposite party.

           A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
