Both parties i.e., decree holder Salama Bibi, wife of Late Sk. Nur Haque and the J. Dr. are present by filing hazira.
Ld. Advocate appearing on behalf of the judgment debtor, The New India Assurance Company Ltd., has submitted before us that the J. Dr., insurance company, has deposited A/C payee cheque bearing no. 190592 dated 10-03-2011 in terms of order of the Forum passed on 21-06-2010 in complaint case HDF 27 of 2010 and the same is related to entire decreetal amount for full and final settlement of the claim.
It is also submitted that the W/A issued in the name of Mr. Sukumar Pradhan, Divisional Manager, J. Dr. company, may be recalled for ends of justice.
Having heard on both sides and the decree holder Salama Bibi has stated before us that she has received the cheque amounting to Rs. 1,47,926/- as full and final settlement and she has no further claim in the decreetal amount and prayed for dispose of the case.
Perused the petition duly signed by the Ld. Advocate for the J. Dr. and also receipt granted by Salama Bibi showing payment of decreetal amount by the J. Dr. as well as payment voucher.

That execution proceeding against the J. Dr. be disposed of on full and final settlement.
Recall W/A against the warranty Sukumar Pradhan, Divisional Manager of New India Assurance Company Ltd., Howrah Divisional Office, Howrah.
Supply the copy of the order to the parties, free of costs, as per rule.
