C.C. No. 2093/2010<br /> 26/11/2010<br /> ORDER<br /> <br /> Complainant present. The learned advocate for the opposite parties also present. The complainant received Rs. 1,900/- price of the mobile and Rs. 500/- cost of the present litigation. In this way total sum of Rs. 2,400/- is received by the complainant. The advocate for the opposite parties submitted that complaint may be disposed of since the opposite party has returned the price amount of the mobile. The complainant submitted that the LG company is selling phones in the market which needs a new software to be upgraded and the customers who buy the mobile set will be in trouble and they will have to run from pillar to post from the day one of their purchase and the complainant submitted that LG company is cheating the public by selling defective phones to the public and making money out of it and putting the public in great difficulty. Therefore, the complainant submitted that strong warning shall be issued to the LG company for playing unfair trade practice. The submission of the complainant is quite just and fair. If at all the company is selling the defective products in the market it definitely amounts to unfair trade practice. Such things need to be corrected. The company shall have to be warned and directed not to sell the defective products. The name of the company will be destroyed and it will affect their credibility. The company should take utmost care and corrective measures before marketing the goods. If any complaints are received from the customers it should be seriously looked into and corrective measures shall have to be taken immediately by the company. If any product found defective the company shall have to recall all the products from the market and express their regret to general public. In this case the customer has complained of defective product of the company and the LG company shall have to be warned that the defective product shall not be released to the market and before releasing any product it shall have to be checked thoroughly and defect free products should only be released to market. This being first complaint received against LG company in respect of defective product, a warning is given to the opposite party company to correct and rectify their mistake and defective product shall not be released to the market in future. In case any further complaints are received from the consumers / customers a punitive action shall have to be taken against the opposite party company. With this warning the complaint is closed. The complainant who has brought to the notice of forum the defective nature of product deserves appreciation from the hands of forum. Hence, complaint is closed and disposed of in terms of above warning.<br /> 2. Send the copy of this Order to both the parties free of costs immediately. <br /> 3.
