This is a complaint filed by the complainant U/s 35 of Consumer Protection Act 2019 for an order directing the opposite party to pay compensation of Rs.50,000/- and Rs.5,000/- as cost to the complainant for the deficiency of service and unfair trade practice on his part.

After receiving the complaint notice issued to complainant and complainant appeared before the commission on 27/12/2022 for admission hearing.  The complainant produced one document (cash bill) along with the complaint.  On perusal of the document it is clear that on 02/12/2022 the complainant ordered food from OP’s restaurant ie, one (Alf) chicken Alfam (Q) cost Rs.140/-.  The OP put 1Ltr mineral of water worth Rs.18.99/- on the table.  Complaint stated that he has used the mineral water and total amount of Rs.158.99/- including CGST, SGST- Net amount Rs.167/- paid to OP.  After paying the bill the complainant questioned that the OP has no right to levy water charge.  According to him the water has give free of charge for using customers in the table.  But the statement of the complainant and the bill clearly shows that the OP has take no unfair trade practice and deficiency in service on his part.  So the complaint is not maintainable.

In the result the complaint stands dismissed.  No order as to cost.
