JUDGEMENT

Complainant Alok Kumar Kanhar has filed this case U/s 35 of CP Act-2019 alleging the deficiency of service on the part of the Opposition Party for not providing him with the Registration Certification of the Trolley and praying therein for direction to the Opposite Party to provide him with the Registration Certificate of the Trolley and to pay a sum of Rs. 2 Lakh for loss and harassment sustained by him.
- Brief fact leading to the case is that complainant Alok Kumar Konhar had purchased one tractor and trolley in the name of her daughter-in-law Archana Pradhan on 09.05.2020. After purchase of the tractor and trolley, the Opposite Party assured the complainant to register the Tractor and the Trolley in the name of the purchaser within a month. But after a long gape of 5 months, only registered the tractor on 30.10.2021 and due to want of required papers, the RTO and police persons imposed fine on the complainant for which, he kept vehicle standing for a period of 5 months and even after the lapse of 5 months period, he did not register the trolley and he sustained loss to the tune of Rs. 2 Lakhs.
- Notice was sent to the Opposite Party and was duly served. But the OP preferred not to appear and challenge the allegation in any manner. Therefore, the Commission proceeded to dispose of the matter on its own merit.
- It is seen from the documents filed by the OP that the OP has only provided the delivery chalan, registration certificate of the tractor but has not provided him the registration certificate of the trolley which amounts to deficiency in service and hence the order.
O R D E R
The complaint petition is allowed expartee against the Opposite Party. The Opposite Party is made liable for causing deficiency of service and harassment to the complainant. The Opposite Party is directed to provide the Registration Certificate to the complainant within a period of 15 days from the receipt of the order and to pay compensation of Rs. 1, 00000/- and a sum of Rs. 10, 000/- towards cost of litigation. If the OP fails to provide the registration certificate of the Trolley within the period as directed, he will go on paying compensation of Rs. 500/- daily to the complainant from the date of order till the order is complied. The order as to cost and compensation shall carry interest @ 12 % per annum from the date of order till its compliance.
