                                      O R D E R

By  Smt.Padmini Sudheesh, President :

          The case is that on 17/5/07 the complainant had deposited Rs.40,000/- with 1st respondent.  It was promised that double amount of the deposited amount will be returned on five years.  But no amount is paid so far.  Lawyer notice was issued to demand the amount.  But no remedy so far.  Hence the complaint.

 

          2. The respondents remained  exparte. 

 

          3. The complainant filed affidavit and Exhibits P1 to P4 documents.  There is no evidence to the contrary.

 

          4. Exhibit P1 is the deposit receipt produced by complainant to show the deposit on 17/5/07.  It is seen that the date of expiry stated as 9/4/09.  So the complaint should be filed within two years from the date of expiry.  But it is filed only on 26/3/14.  So the claim is barred by limitation under Section 24(A) of  Consumer Protection Act.  Since the complaint is barred by limitation it is liable to be dismissed.

 

          5. In the result the complaint stands dismissed.
