SRI.P.V.JAYARAJAN: PRESIDENT
This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complainant filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complainant notice was issued to the opposite party. Though the opposite party accepted the notice issued by this Commission, the opposite party failed to appear before this Commission on the date fixed for their appearance or on subsequent dates. Meanwhile the original complainant expired on 12/12/2020 and deceased complainant’s only legal heir who is the husband of the deceased complainant filed an application as IA No.146/2021 to implead him as additional 2nd complainant. As the opposite party was absent, notice in the above application was also issued to the opposite party. After accepting the notice the opposite party not turned up before this Commission and hence this Commission declared the opposite party as ex parte. The impleading petition was allowed. When the case came up for consideration today the complainant filed a memo stating that the matter is settled between the parties to the dispute. The memo of settlement filed by the complainant is accepted and recorded. In view of the settlement arrived at between the parties to the dispute, we find that this is fit case to be dismissed.
In the result the complainant is dismissed as settled. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
