ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                         JUDGMENT

            Complainant has filed the consumer complaint U/s.35 of Consumer Protection Act, 2019 seeking not to repossess the vehicle bearing Regd. No.OD-05-W-4424 and compensation of Rs.4,50,000/-.

            Opposite parties have appeared and field written version opposing the prayer on the ground of resjudicata, suppression of fact and final award passed under Arbitration & Conciliation Act, 1996.

            Issued raise in this case has already been adjudicated in C.C. No.183/2021. The relation between complainant and opposite parties is that the debtor and Creditor and there is no element of deficiency in service and complainant cannot be termed as a consumer being owner of multiple vehicles. Besides that final award under Arbitration & Conciliation Act, 1996 has already been passed on 28.11.2022 prior to filing of the present consumer complaint. Hence we find no merit in the consumer complaint. Accordingly the consumer complaint and I.A. No.210/2023 are dismissed. No cost.
