ORDER
Complainant has filed this Complaint seeking direction against the OP to issue Loan Clearance Certificate and to release the documents of the vehicle KA-07/K-2545 and to pay Rs.41,000/-.
Complainant had obtained certain loan from the OP and purchased 2 Wheeler vehicle bearing Regn. No. KA-07/K-2545 on 21.11.2003 agreeing to repay the loan to the OP in 30 EMIs. Accordingly, Complainant has paid EMI of Rs.1,100/- per month from 21.11.2003 upto 21.04.2006 regularly and no amount is due. After paying the entire amount, Complainant is seeking OP to issue Loan Clearance Certificate and also original documents which were given to the OP while obtaining the loan. Complainant requested the OP on 13.03.2012 in this regard and also issued notice on 02.04.2012. In spite of that, OP has failed to comply the same. Hence filed this Complaint.
In spite of service of notice, OP remained absent throughout the proceedings. Hence, Complainant has filed affidavit.
Arguments were heard.
During the course of arguments, the Learned Counsel for the Complainant submitted that he may be permitted to withdraw the Complaint with a liberty to file fresh complaint on the same cause of action making necessary amendments as the case may be.
In view of the above, we pass the following order:
ORDER
Complaint is dismissed as withdrawn with a liberty to the Complainant to file fresh complaint on the same cause of action with necessary applications / amendments if need be.
Return extra sets to the Complainant.
