ORDER

By G. Yadunadhan, President: The case of the complainant is that, complainant purchased a Maruthi Alto car through ICICI Bank in a loan facility. Complainant agreed to repay an amount of Rs.6675/- on a monthly instalment. The total loan amount is Rs.1,74,325/-. Complainant closed the entire loan on 17.9.2007. While availing the loan, complainant handed over 29 cheque leaves to the opposite party. Opposite party already cleared 18 cheque leaves. Meanwhile, complainant closed the entire loan. After repeated demands, opposite party hesitated to return the excess amount already collected and the balance cheque leaves. Hence complainant seeking relief against the opposite party to return 11 cheque leaves and excess amount of Rs.4157/- already collected and also to pay a compensation of Rs.10,000/-. After duly serving notice to the opposite party, opposite party called absent and set exparte. Complainant filed affidavit and Exts. A1 to A5 were marked. From the affidavit and Exts. A1 to A5, complainant’s case is proved. Therefore, petition is allowed and the opposite party is directed to return the balance cheque leaves, 11 in number series, which is already submitted with the opposite party and to repay the excess amount of Rs.4,157/- and also to pay a compensation of Rs.2,000/-. Comply the order within one month. Pronounced in open Court this the 28th day of November 2008.
