SRI.R. VIJAYAKUMAR, MEMBER. The complaint is filed for getting Rs.9250/- as compensation along with cost. The averments in the complaint can be briefly summarized as follows: Attracted by the advertisement in medias regarding an offer of Rs.35,000/- for purchase of new Sandro car the complainant contacted the officials of 1st opp.party and they informed the complainant that he would be given only the offer of Rs.25000/- Accepting the offer of Rs.25,000/- the complainant booked a Santro Zing XL Car on 28.5.07 remitting Rupees One Lakh and five hundred rupees and the balance amount was remitted on 27.7.2007. The amount of offer reduced to an amount of Rs.15,750/- . The complainant sent a notice to the 1st opp.party but no reply received yet. The complainant is a consumer of opp.parties and the act of opp.parties amount to deficiency in service. Hence the complaint. Sufficient opportunities were given to the opp.parties. They have failed to file version and to adduce evidence. The points that would arise for consideration are: 1. Whether there is any deficiency in service on the part of opp.party 2.Compensation and cost. The complainant filed affidavit. PW.1 examined. Ext.P1 and P2 are marked. As the opp.parties failed to file version or adduce any evidence we are constrained to relay upon the evidence adduced by the complainant. The complainant was not cross examined. Hence evidence adduced by the complainant stands unimpeached. In the result the complaint is allowed directing the opp.parties to refund Rs.9250/- along with an interest at the rate of 9% per annum from the date of purchase till the date of payment of this amount. The opp.party is also directed to pay Rs.1500/- as compensation and cost. The order is to be complied with within one month of the date of receipt of the order. Dated this the 31st day of July, 2009.
