This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. The notice issued to the 1st opposite party was returned with endorsement “addressee left”. After accepting the notice the 2nd opposite party failed to appear before this Commission and hence on 16/06/2023 the 2nd opposite party was called absent and set ex pate. Since 20/07/2023 this case is adjourned for taking steps against the 1st opposite party. As the complainant was continuously absent, a notice was issued to the complainant to appear before this Commission on 29/09/2023 to further proceed with this complaint. When the case came up for consideration on 29/09/2023, the complainant was present and sought time for steps against the 1st opposite party. Subsequent to that the case was adjourned to 13/11/2023, 16/01/2024, 25/03/2024 and 05/06/2023 i.e. today for taking steps against the 1st opposite party. Inspite of giving sufficient opportunities the complainant failed to take steps against the 1st opposite party and in the above circumstances we find that the complainant is not interested to further proceed with this complaint. Hence we find that this is a fit case to be dismissed.
In the result complaint is dismissed. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
