            Complainant has paid Rs.1800/- to the agent of the opposite party for getting a cable T.V. connection from the opposite party.  They were not given the said connection till the date of filing the complaint.       

            2.  Opposite party filed version stating that the complainant has already availed a connection from the franchise of the opposite party M/s.  Perumpallil communications.  Complainant made default in the monthly subscription and Rs.6400/- is due as arrears to M/s.Perumpallil communication.   Hence they were disconnected the cable connection.  Now the complainant is trying to get a new connection in the same house in another name.   Hence the opposite party has not given connection.   So there is no deficiency of service on the side of the opposite party.    Hence  they prayed that the complaint may be dismissed.

            3.  Considering the rival contentions of the complainant and opposite parties this Forum raised following issues:-

            Whether the complainant is entitled for compensation from the opposite parties establishing the deficiency as averred in the complaint?

            4.  Complainant filed proof affidavit.   He examined as PW1 and produced one document marked as Ext.A1.   Opposite party also filed proof affidavit and two  documents which is marked  as Ext.B1 and B2.    On going the evidence in this case, it can be seen that one Anoop Raj who is the same resident in the house of the complainant availed a connection from M/s. Perumpallil communications and committed default in payment of monthly subscription.    The arrears of monthly subscription pending from the said consumer is Rs.6400/-.  In these circumstances opposite party has not given connection.  One evaluation of entire evidence in this case, it can be seen that the case of the opposite party is true.  Hence this Forum found that this no deficiency in service on the side of the opposite party.

            In the result, the complaint is dismissed.  No order on cost.
