FINAL ORDER
The instant complaint has been filed by the complainant u/s 12 of C.P. Act, 1986 praying for direction upon the OP to return the Blue Book with concerned papers of the said tractor and for compensation of Rs.5,00,000/-.
The complaint, in brief, is that the complainant, a cultivator, purchased a Mahindra Swaraj Tractor with the financial assistance of OP No.1 for agricultural use on the basis of contract made with them. From the date of purchase the said tractor was kept in from of the house of the complainant for want of valid documents and OP Nos. 1 & 2 are continuously threatening the complainant to pick up the said tractor and as such the complainant is compelled to file this case. Hence, the instant complaint.
Now the complainant has filed Put up petition along with a petition for praying for dismissal of the case for non-prosecution being settled on compromise.
The complainant appeared before the Forum personally and submits that the dispute between the parties has been settled on compromise. He has got Back Blue book and other relevant documents in respect of the tractor in question. He has also submitted that he is not willing to proceed with the case further and has prayed for dismissal of the case.
Considering the submission of the complainant as well as the petition filed by the complainant , we are of the view that the case be dismissed for non-prosecution being settled on compromise.
Hence,
Ordered
That the Consumer Complaint No. 148/2014 be and the same is dismissed for non-prosecution being settled among the parties on compromise.
There is no order as to cost.
Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under registered post with A/D to the concerned parties as per rules, for information and necessary action.
